Florida Realtors Leadership Team approved a few changes to the association’s forms. Most changes went into effect on July 10, 2018, and are now reflected in all forms available through Form Simplicity as well as Florida Realtors other licensed vendors. The change to initials goes into effect on July 17, 2018.
Breakdown of changes
Contract to Lease: Paragraph 12, regarding renewal commission, was removed.
Multiple forms – initials: On a number forms, the parties have a space at the bottom where they sign their initials. Going forward, the order of those initials will be switched. The impacted forms include:
Residential Lease for Apartment in Multi-Family Rental Housing (RLAUCC)
Residential Lease for Single Family Home or Duplex (RLHD)
Contract to Lease (CL) (Changed July 10, 2018)
Seller’s Property Disclosure – Condominium (SPDC)
Seller’s Property Disclosure – Residential (SPDR)
Vacant Land Disclosure (VLDS)
Form Notice and Disclosure – This optional form was created for agents’ use in the event that the contract form being used in the transaction is one the agent does not use in the regular course of business; i.e., a party’s attorney drafted it or the form is coming from a REO lender. It provides that the party may want to seek appropriate legal, tax or other professional advice before moving forward in the transaction.
Exclusive Right to Lease – This form was modified in section 2(c), which deals with the current occupancy of the property, and specifies whether it is a tenant or the landlord and, if tenant occupied, when the lease ends.
